Much has been written about the epidemic of HIV/AIDS in Africa, and many countries are facing the gravest health and development crisis in their history. Despite this, there continues to be a tendency to misunderstand the nature of the African situation and response. (...) This paper offers a critical reading of "African AIDS" and the discourses upon which it feeds. It highlights the role of colonialism and neo-colonialism in producing and reproducing images of Africa as helpless and in need of "assistance". It points to the continued impact of such ideas on international development policy and practice. The HIV/AIDS pandemic will transform Africa as we know it. Taking a pessimistic view of current trends, this article foresees the emergence of AIDS-related national crises (ARNCs). Just as HIV infection itself kills through other infections, the pandemic-induced crises will manifest themselves in a range of other social, economic and political pathologies, with potentially severe implications for food security. Most current models of the AIDS pandemic assume that governance of affected countries will remain unchanged or even improve in the face of these crises. However, these approaches have left out a potentially crucial element of negative feedback. In light of these special features of ARNCs, normal responses to these crises will not work, and may in some respects make the situation worse. The priorities of development partnerships will need to be re-evaluated, and concerted efforts must be taken toward prevention. The article concludes that African nations, and their international partners, may need a new model of governance over the next few decades that reflects the far-reaching impacts of ARNCs. This article addresses the slow response of corporate South Africa to HIV/AIDS. (...) Two explanations for the slow response of business are conventionally offered - that government failure to lead a national response to the epidemic confronted business with an insurmountable collective-action problem; and that managers misunderstood the vulnerability of their companies. It is argued that these explanations have validity, but do not fully satisfy. Rather, account must be taken of inescapable tensions that tangibly link internal and external environments in ways that pre-date and exist independently of any strategy seeking to respond to HIV/AIDS. Four such tensions are identified: political, moral, industrial relations, and socio-economic. (...) While progress has been made by business in responding to HIV/AIDS, these conflicts remain significant. (...) Recent research conducted in Lesotho, Kenya and South Africa has revealed that HIV/Aids will seriously impact on a range of land issues as a direct result of very high infection rates in these countries. HIV/Aids will affect different forms of land use, the functioning of land administration systems, land rights of women and orphans as well as the poor generally, and inheritance practices and norms.(...) Affected households fall below the social and economic threshold of vulnerability and 'survivability', leaving the survivors - mainly the young and elderly - with limited resources to quickly regain a sustainable livelihood. This indicates the importance of effective land administration systems and of land rights as HIV/Aids impacts on the terms and conditions on which households and individuals hold, use and transact land. This has a particular resonance for women and children's rights, which, in the context of rural power relations that are themselves coming under increasing pressure from the epidemic, are especially vulnerable to being usurped. Thus, the impact of HIV/Aids on land raises complex and sensitive issues for land policies and programmes, particularly if they are intended to underpin rural development and sustainable livelihoods. In July 2002, the Constitutional Court gave judgement in the Treatment Action Campaign (TAC)'s constitutional challenge to government's policy of limiting the provision of Nevirapine for the purpose of preventing mother to child transmission (PMTCT) of HIV to a limited number of "pilot sites". (...) This paper contextualises the litigation that challenged the South African government's PMTCT policy and documents its causes and effects. It examines the resort to constitutional litigation by civil society organisations. (...) The TAC case is an interesting one, both inside and outside of the legal proceedings. It raises important issues about the functional independence of the public service from the Executive on matters where there is political sensitivity and pressure. (...) Eine reibungslose fiskalische Zusammenarbeit zwischen den verschiedenen staatlichen Ebenen ist eine entscheidende Voraussetzung für eine effiziente Lenkung nationaler und internationaler Gelder zur Bekämpfung von Aids. Vor diesem Hintergrund stehen hier die zwischenstaatlichen fiskalischen Beziehungen innerhalb Südafrikas im Hinblick auf HIV/Aids im Vordergrund. Die entsprechende Ausgabenpolitik wird als Testfall für eine kooperative Regierungsarbeit gesehen. Von Bedeutung sind dabei: Die vorgegebenen Prinzipien der Verfassung; das Interventionsgebot der ökonomischen Theorie; die südafrikanische Ausgabenpolitik zur Bekämpfung von HIV/Aids sowie deren zukünftige Entwicklung angesichts der Herausforderung von HIV/Aids an den Staat. Südafrika ist von der AIDS-Pandemie stark, die Provinz Mpumalanga besonders stark betroffen. Mittlerweile sind alle gesellschaftlichen Bereiche affiziert: die Zahl der AIDS-Waisen wächst, die Sozial- und Gesundheitsausgaben steigen, die Investitionen und das Wirtschaftswachstum nehmen ab. In dieser Situation hat die Provinzregierung entschieden, alle Regierungsaktivitäten auf den Kampf gegen AIDS auszurichten ("Mainstreaming"). Diesen Prozess durch Beratung zu unterstützen war die Aufgabe eines GTZ-Projekts, das das Seminar für Ländliche Entwicklung (SLE) durchführte. Es wurden zahlreiche Workshops abgehalten, dessen Ergebnisse in Empfehlungen mündeten. (DÜI-Sbd)

This paper provides an overview of the literature concerned with the impact of HIV on public administration, looking in particular at projections of the impact of HIV/AIDS on public expenditure, the impact of attrition on the health and education sectors and on the civil service as a whole. "Success stories" such as Uganda and Senegal are discussed through their representation in the literature, and "political commitment" is identified as a critical but under-theorised factor in tackling HIV. Having taken as its starting point the existing work on HIV and governance, the paper then considers the impact of the epidemic in conditions of state vacuum - conflict situations. The paper concludes that governance is both victim of, and part of the solution to, the problems of HIV/AIDS. (InWent/DÜI)

Addressing Aids and unemployment is one of the greatest challenges facing South Africa at present. Health and welfare interventions will be costly and are likely to meet with resistance from taxpayers. Expanding employment (which will help alleviate poverty and expand the pool of taxpayers) is thus necessary. An inclusive social accord could help, but only if organised labour is prepared to make concessions, as was the case in the new social accords in Australia, Ireland and the Netherlands. Since 1994, South Africans have witnessed the unexpected and enigmatic politicisation of sexuality to an unprecedented extent. This paper attempts to demonstrate, and make sense, of this phenomenon. It is structured in two parts. The first part considers "how sex is brought into the realm of discourse", as Foucault put it, and how this discursive constitution of sexuality is informed by wider dimensions of the post-apartheid social order - in particular, the acceleration of the country's HIV/AIDS epidemic, on one hand, and the generational shifts associated with the emergence of new black elites, on the other. Drawing on this discussion, the second part proposes a reading of the so-called "HIV/AIDS controversy" which has come to summarise Thabo Mbeki's presidency in many national and international circles. This article analyses the complex cultural politics of HIV/AIDS in South Africa. It focuses on how AIDS "dissident" science impacted on policy discources and how AIDS activists, together with scientists, the media and health professionals, responded. (...) Activists from the Treatment Action Campaign (TAC) deployed a class-based politics that concentrated on access to anti-retroviral drugs rather than debates on the complexities of AIDS causation. The article discusses how TAC and its partner organisation, Medicins Sans Frontières, strategically positioned themselves in the struggle for access to AIDS drugs, and how new forms of health citizenship, gendered identities and political subjectivities emerged in the course of these struggles. While TAC's strategies included networking with global civil society organisations such as MSF, Health Gap, and Oxfam, they also involved grassroots mobilisation and an engagement with local socio-cultural realities. This article explores the organisational practices and strategies of the Treatment Action Campaign and strategies of the Treatment Action Campaign (TAC), an AIDS activist social movement in South Africa. TAC, like other new social movements, draws on grassroots, bottom-up, network-based modes of organisation that operate simultaneously in diverse local, national and global spaces. The article argues that TAC provides examples of organisational practices that cut across institutional and non-institutional spaces, and that are capable of generating multiple relations to the state. In doing so, it has provided its members with opportunities to engange simultaneously in a variety of participatory spaces that allow for the articulation of new forms of citizenship from below.
