This article argues that good governance has been elusive in much of Africa. The failure of the Organisation for African Unity (OAU) to address Africa's developmental challenges, including the crisis of governance, led to its demise. In an attempt to promote good governance, as well as to address Africa's post-cold war legion of challenges, the successor organisation, the African Union (AU) and its attendant development programme, the New Partnership for African Development (NEPAD), were established. These projects embody an innovative peer review mechanism by which African governments are assessed in terms of their progress towards good governance. (...) However, the article contends that in spite of the expectations and euphoria generated by these projects, they have a truncated capacity to induce good governance. This is not only due to the intrinsic contradictions in these initiatives, but also because of a confluence of factors, including the vulnerability of the projects to manipulation by African leaders, the preponderance of neopatrimonial politics in Africa, the confusing relations between especially NEPAD and the AU, and the tendency for the G8 - Africa's key partners - to renegade from their initial aid commitments. Im Unterschied zum Prinzip der OAU, nämlich der unangefochtenen staatlichen Souveränität, erlauben die Prinzipien der Nachfolgeorganisation African Union im Zusammenhang mit den Zielen des NEPAD-Entwicklungsprogramms eine zumindest teilweise Aufgabe dieser staatlichen Allmacht. Zu den NEPAD-Zielen gehört die Förderung wirtschaftlicher Integration und zwischenstaatlichen Handels. In diesem Rahmen wiederum muss die zwischenstaatliche Wanderung von Arbeitskräften als eine wichtige Entwicklungsressource angesehen werden. Der Beitrag untersucht das Management dieser Arbeitskräftewanderung als ein Aspekt der regionalen Kooperation. Im einzelnen werden angesprochen: Faktoren, die die Wanderung beeinflussen; Trends der internationalen Migrationspolitik nach dem 2. Nach der offiziellen Gründung der Afrikanischen Union (AU) im Juli 2002 in Durban betrachtet der Autor deren Entwicklung und die Chancen, die afrikanischen Länder unter dem Dach der AU zu integrieren. Er entdeckt zwei große Strömungen: Revisionisten (v.a. Südafrika, Nigeria, Algerien und Senegal) und Gegen-Revisionisten (v.a. Libyen und Simbabwe). Die enorme Schwierigkeit der Integration bestehe in der Tatsache, dass sich die Länder nicht (wie in der EU) für eine Mitgliedschaft qualifizieren müssten, sondern schon durch ihre geographische Lage willkommen seien. Institutional strengthening has characterised the transformation of the OAU into the AU. This contribution focuses on two new judicial institutions in Africa, the African Court on Human and Peoples' Rights (ACHR) and the African Court of Justice (ACJ). The ACHR Protocol, adopted in 1998, and entering into force in 2004, mainly entrusts the ACHR with the application and interpretation of the African Charter on Human and Peoples' Rights (African Charter). The ACJ Protocol, adopted in 2003, not yet in force, establishes the ACJ as the AU's principal judicial organ. The authors try to balance the important role of the ACJ in realising human rights with the need for coherence, consistency and certainty with respect to African human rights law. This article analyses the significance of the newly established "Pan-African Parliament". As one of the few genuinely new institutions of the "African Union" (AU) - itself the successor of the "Organisation of African Unity" (OAU)-, the Parliament's birth could provide the institutional transformations that have taken place in continental politics with more concrete meaning. After sketching the historical background to the idea of parliamentary representation in the (O)AU, the article outlines the African Union's formation and how this interconnected with the notion of a parliamentary gathering. It analyses in detail the Parliament's Protocol, the structures and powers with which it was provided, and its formal relations with the other organs of the Union. The article describes how the Parliament was formally launched in March 2004 and then gives an assessment of its possible impacts on the institutions of the AU; on AU policy-making; and on the Union's member states. Its potential role in the review mechanisms of the CSSDCA and NEPAD is also discussed. The article concludes that the Parliament's influence will remain marginal for the foreseeable future.
