Die Neue Nationale Partei (NNP) in Südafrika steht immer noch für viele als die Partei, die Apartheid ein- und mit allen Konsequenzen durchgeführt hatte. Im November 2001 trennte sich die in politische Bedeutungslosigkeit abdriftende Partei von der Demokratischen Allianz (DA) und paktierte mit dem ehemaligen Erzfeind, dem Afrikanischen Nationalkongress (ANC). Nach einer langwierigen und an Ende misslungenen Identitätsfindung in der neuen Demokratie ringt die NNP nun ums politische Überleben. Dass sie dieses nun ausgerechnet beim ANC sucht, ist eine Ironie der Geschichte. (Afr Süd/DÜI)

In this article, I analyse Thabo Mbeki's call for an African Renaissance, and argue that, as a general response to the crisis in Africa, the African Renaissance should be debated within a broader intellectual tradition of renewal. I further argue that the African Renaissance is an imperative because it demands a post-nationalist agenda that takes the African region seriously, calls for the revitalisation of Africa's cultural ideals, and promotes a new political culture. Uncertainty concerning South Africa's future political development prevailed during the period of transition to majority rule. A new political playing field was created by the elections held in 1994 for the National Assembly and the Provincial Legislatures. These were the first inclusive elections in South Africa based on the principle of universal franchise. The old regime lost its ruling power and its long-time enemies were now the rulers. The party system of the South African polity experienced an influx of new actors. With the new actors came new actions, interactions and alignments among the various political parties, but also new interactions with the electorate and government. Many questions were raised concerning future changes and trends in the party system once the actors had settled. (...) Identifying changes and trends in voter participation, fractionalisation, the number and spectrum of political parties, the radical and functional orientation, as well as the polarisation of the party system and voter volatility provide important information on the political situation in South Africa as well as future prospects for the South African polity. Politische Systemwechsel werfen die Frage auf, wie mit den begangenen Verbrechen des überwundenen Regimes umzugehen ist. Die Forderungen reichen von einer umfassenden Strafverfolgung bis hin zu einem Schlussstrich. Gerade eine strafrechtliche Aufarbeitung von Systemunrecht stößt schnell an ihre Grenzen, da die Taten verjährt sein können, einer Bestrafung das Rückwirkungsverbot entgegen stehen kann und völkerrechtliche Normen, die die Unrechtstaten unter Strafe stellen, nicht ohne weiteres anwendbr sind. Südafrika versuchte, die Grenzen einer strafrechtlichen Unrechtsaufarbeitung zu überwinden. Im Umgang mit dem Apartheidsystem zu Beginn der neunziger Jahre entwickelt das Land ein neues Modell: Durch die Einsetzung der Wahrheitskommission (Truth and Reconcialiation Commission) erhielten die Opfer ein Forum, über ihr Leid zu berichten, während die Täter gegen ein Geständnis für ihre Taten amnestiert werden konnten. Aber auch dem südafrikanischen Modell wird vorgeworfen, nicht alle Aspekte des Apartheidunrechts behandelt zu haben. Insoweit bleibt die Frage, ob Systemunrecht überhaupt umfassend aufgeklärt werden kann. (Recht Afr/DÜI)

The South African Truth and Reconciliation Commission (TRC) was mandated to establish "the truth" about the causes, nature and extent of gross violations of human rights in the country between 1960 and 1994. This article assesses the significance of the TRC for historians and the writing of history in South Africa. (...) Despite (...) shortcomings, the significant contributions of the TRC towards producing a new archive of previously repressed histories, from which a fuller truth about the past could emerge, cannot be denied. (...) It is the main objective of this article to reflect upon the tasks of historians after the TRC. (...) They have an important task to attend to the unfinished business of the TRC and to resist denial or erasure. This article sets out to trace the intellectual and political antecedents of the Truth and Reconciliation Commission (TRC) in the longer perspective of South African history. It does so by taking a closer look at some of the longstanding if intermittent series of South African projects invoking notions of truth and justice, most recently exemplified by the TRC in the context of the new democratic and post-apartheid South Africa of the 1990s. It traces the history from Stockenström's stand for truth and justice on the frontier in the 1830s, through Gandhi's mobilisation of "truth-force" as a resource for popular protest at the beginning of the twentieth century, to truth and justice in the theory and practice of the TRC. This article questions the export of "social exclusion" discourse to the field of development and poverty studies. It considers the findings of ongoing research into chronic poverty in the Western Cape district of Ceres, one of the centres of the South African deciduous fruit export industry. It explores the links between the livelihood options of poor people and processes of global integration, agrofood restructuring and the modernization of paternalist farming styles. In this context the concept of "social exclusion" is of only limited utility, and has significant disadvantages. Although it has the potential to focus attention on the disabling effects of poverty, its most common usage often fails to capture how poverty can flow not only from exclusion but also from processes of integration into broader economic and social networks. The author argues that these are better captured by the notion of "adverse incorporation", and calls for a more cautious approach to the modernizing myths and moralizing narratives that shape policy debates. This article takes a 'second look' at the place of the South African Human Rights Commission and its role in the promotion of socioeconomic rights through monitoring. It argues that a 'first look' at understanding drew heavily on international concepts of monitoring, including violations and progressive realization. These concepts have proven to be of limited usefulness in a national context where the justiciability of socioeconomic rights has been achieved. This 'second look' proposes an alternative model of national monitoring of socioeconomic rights, based on greater participation, transparency, and a constitutional right of access to information. This article enquires into the defensible limits of judicial review. The United States Supreme Court has recently been castigated for overreaching. According to this charge, judges have unjustifiably intruded on the domain of other branches of government by exercising 'political' functions. Critics urge that judges should desist from overreaching by exercising self-restraint, that is, by restricting themselves to the interpretation of rights, rather than interfering with government policy. This article examines selected judgments of the Constitutional Court as examples of judicial self-restraint and scrutinises divergent visions of the judicial role, particularly the judiciary's understanding of its own role. It enquires whether the Court's rhetorical support for judicial restraint is translated into a practice of restraint and, if so, what effect this has on the protection of individuals' rights. The success of South African companies in achieving their economic and trade interests in Southern Africa as well as their intensified expansion into the region are situated within the position of South Africa in a hierarchy of economic, political, financial, technological, trade and military international power relations which extend from the USA at the centre of capitalism to the African continent and its Southern African region at the periphery of capitalism. South Africa's intermediate position in international power relations helps to explain why South Africa's trade and economic relations with the rest of Southern Africa and Africa are increasingly in favour of South Africa. Successful economic and trade strategies of South African companies in achieving their economic and trade interests are the product of this position. Discussing the strategic importance of other Southern African countries to economic and trade interests of South African companies, our paper also discusses the reality that socio-political and economic policies of other African countries, particularly those of Southern Africa, enabled South African companies to achieve their economic and trade objectives throughout the region. This article is based on a survey of popular attitudes towards the pure list system that is South Africa's proportional representation electoral system. While the reported findings are broadly positive there are some notable exceptions, located disproportionately among racial minorities and also among sizable numbers of black respondents. Pure proportional representation is unlikely to produce the values that the respondents say they most want from a voting system. The significance of the survey's findings is analysed and reasons are advanced for making changes to the electoral system. More specifically, the delivery of equal political rights in the new democracy is premised on the acceptance of the unequal economic relations among different classes, gender and race. South Africa's foreign policy, conducted in an ad hoc and haphazard fashion under President Nelson Mandela, has been consolidated under the presidency of Thabo Mbeki. This article first outlines five consistent policy themes: Africa and Africanist; democracy and respect for human rights; a holistic understanding of security; a pacific approach to conflict resolution; and multilateralism. The article then identifies and attempts to explain a number of significant inconsistencies in relation to these themes, including Mbeki's 'quiet diplomacy' on Zimbabwe; his denialist position on HIV/AIDS; South Africa's controversial arms procurement programme; and its domestic xenophobia. This article critically reviews the impacts of the first ten years of the national government's small, medium and microenterprise (SMME) programmes. In particular, the evaluative focus is in terms of impacts in relation to a range of policy objectives, including poverty alleviation, job creation and the enhancement of national economic growth as part of post-apartheid reconstruction. Key findings relate, inter alia, to the weak state of official data for undertaking impact evaluation; the fact that the SMME economy exhibits only a weak contribution as regards employment creation because most SMMEs do not grow; and, the fact that existing government SMME programmes largely have been biased towards the groups of small and medium-sized enterprises and, to a large extent, have bypassed microenterprises and the informal economy. The Land Claims Court of South Africa ('the LCC') was established in 1996. (...) Almost ten years after its establishment, the LCC plays no meaningful role in the land restitution process (...). This article draws on the work of a group of scholars who are studying the role of courts in new democracies. The study design assumes that the capacity of courts to be used as agents of social transformation is influenced by a number of indicators, including institutional indicators, indicators of poor groups' voice, resource indicators, and indicators of access to justice barriers. (...) If the theoretical model tested in this article is sound, this means that the performance of the LCC must be explicable in terms of one or more of the posited institutional indicators. Testing this hypothesis, the article examines four areas of law in which plausible pro-poor arguments were made before the LCC, only for these arguments to be rejected or ignored in the decisions handed down. The article then attempts to explain these 'anti-poor' outcomes by reference to three institutional indicators: the doctrinal force of the common law, the influence of legal culture, and professional concerns amongst the judges about how their decisions are perceived. The article finds that the continuing influence of legal formalism in South African professional legal culture provides an adequate explanation for most of the decisions studied. Where a legal culture is overwhelmingly formalist, the use of general, discretion-conferring language in social transformation statutes is likely to be less successful than the enactment of detailed, prescriptive rules. Die neue politische Elite Südafrikas wird vom African National Congress (ANC) dominiert. Viele Mitglieder des ANC wurden durch langjähriges Exil geprägt, und ehemalige Exilanten bilden heute in der ANC-Führung und der Regierung die Mehrheit. Die vorliegende Studie sucht die Einflüsse von Exil und Exilerfahrungen auf aktuelle Entwicklungen, gesellschaftspolitische Strategien und die politische Kultur in Südafrika zu ermitteln. Während des Exils 1960 bis 1990 hatte der ANC zunächst unter komplizierten Bedingungen um das Überleben zu kämpfen, konnte dann jedoch seine Auslandsverankerung zunehmend für die Stärkung seines nationalen und internationalen Ansehens und für die inhaltliche und personelle Vorbereitung auf eine politische Machtübernahme nutzen. Der Autor untersucht am Beispiel zweier Schlüsselregionen der südafrikanischen Diaspora - den afrikanischen Frontstaaten und Großbritannien - Bedingungen und Entwicklungslinien des Exils, vor allem aber dessen Einfluss auf die politische, professionelle und auch persönliche Entwicklung von ANC-Führungskräften. The persistence of the debate about whether the African National Congress (ANC) can or should be characterized as a "dominant party" was illustrated by exchanges between the country's leading political parties during the 2004 general election. The ANC, which views its hegemony as expressing its popularity, rejects its depiction as a 'dominant party' as inherently hostile, conservative and racist. In contrast, the Democratic Alliance (DA) and its associated analysts warn against dangers posed to democracy by the ANC's arrogance, freedom from accountability, and its ambitions to extend increasing control over the state and society. After a review of the central tenets of the debate, the present article suggests that both sets of antagonists exaggerate their case. In contrast, whilst accepting that the ANC's electoral and political hegemony does carry threats to democracy, it also proposes that the ability of the ANC to extend its dominance is subject to considerable limitations. This argument is pursued through analysis of such factors as the multidimensionality of party dominance, the extent to which the ANC's attempted centralization of power is constrained by constitutional, political and economic realities, the perpetuation of debate within the ANC and between itself and its principal allied organizations, and finally the difficulties faced by the ANC in imposing its authority upon a society as complex as that of South Africa. The conclusion argues that the dominant party thesis, whilst too often exaggerated, is too important and insightful to be abandoned, and that careful analysis suggests that the basis of ANC dominance is far from static, and is likely to be subjected to considerable challenge over coming years. Das Phänomen des Parteiwechsels von Abgeordneten (floor crossing/defection) stellt in entstehenden und/oder postkolonialen Demokratien ein besonderes Problem dar. Indien hat 1985 ein "Anti-Defection Act" eingeführt, das individuelle Parteiübertritte erlaubt, aber En-bloc-Übertritte verbietet; in Südafrika wurden 2002 heftig umstrittene Floor-Crossing-Gesetze verabschiedet, die den Parteiwechsel erlauben, aber auf Zeitfenster begrenzen. Anhand des Ländervergleichs - Indien und Südafrika - wird das Argument entwickelt, dass die Art und Weise, wie mit dem Phänomen des Parteiwechsels umzugehen ist, von dem Wahlsystem eines Landes abhängt und die Unterschiede hinsichtlich Ausmaß, Konsequenzen und Management mit der jeweiligen Konfiguration des Parteiensystems zusammenhängen. South Africa has undergone significant changes since 1994. Some of these relate to its foreign policy and how this policy translates into its international relations. Taking a constructivist approach to these changes, this contribution follows the ideas of Alexander Wendt, Friedrich Kratochwil and Nicholas Onuf. Alexander Wendt claims, inter alia, that state identities are constructed, not made. Friedrich Kratochwil contends, inter alia, that norms and rules matter and, lastly, Nicholas Onuf reminds us that words often make the world. This article deals with aspects of South Africa's post-1994 identity, its roles and interactions. In addition to identifying various norms and principles guiding South African foreign policy, the article addresses a number of policy issues relating to these. This article introduces the topic of democratic challenges and opportunities by referring to the nature of democracy and the proportional representation electoral system as applied in South Africa. The dominance of the ruling African National Congress and the fragmentation of the opposition are referred to. The centralisation of power is also discussed, as are the characteristics of South African society, which remains an open society. A blurring between the party and the state has taken place, and the point is made that there is no attested case where simple majoritarianism has sustained democracy in a divided society. The conclusion drawn is that, on the tenth anniversary of South Africa's transition, the quality of the country's democracy receives a mixed report. (Politeia/DÜI)
