East Timor is the newest state of the twenty-first century. Yet its human development indicators compare with the most severely collapsed states in the world. Two and a half years of international administration by the United Nations seems to have had little effect on a social and political reality that has evoled by itself. The intervention failed to decentralize its own absolutist form of authority but succeeded in excluding the local population from the equation. "Participatory intervention" is the next doctrinal puzzle to solve in the evolution of international state-building enterprises of any brand. (Developm and Change/DÜI)

Centuries of Portuguese rule and decades of Indonesian rule over East Timor did not manage to eradicate local socio-political structures that have proved resilient. It is, therefore, not surprising that a state-building exercise by the international community was unable to have much effect on, let alone transform, the local level. This article assesses the clash between the international paradigm of attempting to (re)build the Western liberal-style, democratic state under UNTAET and the existing indigenous paradigm of traditional political legitimacy that prevails among the majority of the population at the local level. Without reconciling the two in future UN interventions, such efforts will continue to be either irrelevant to a self-evolving reality or in fact cause local systems to collapse without being able to adequately replace them. The puzzle of how to build local government, given the two unrelated paradigms, has to be solved. (Contemp Southeast Asia/DÜI)

As East Timor emerges from a long Indonesian nightmare, it is seeking to balance the agendas of justice and reconciliation. The verdict on justice for East Timor is one of disappointment. The main obstacle to accountability is Indonesia, abetted by an international community that seeks its assistance in the “war on terror”. East Timor’s leaders have emphasized reconciliation while promoting a healing process and good governance. Recent violence reveals just how difficult this task remains. The hybrid tribunal established in East Timor by the UN was once heralded as an important innovation in transitional justice, avoiding the high cost and lengthy proceedings of other international tribunals. However, the tribunal has been unable to hold accountable those who bear the greatest responsibility for outrages committed against Timorese and defendants did not get fair trials or competent defense. A truth commission report released in December 2005, Chega! (Enough), emphasizes justice and reparations. The political leadership soft peddles justice because they believe this makes more sense and will better serve the people. Indonesians are now being given a chance to testify in front of the Commission of Truth and Friendship (CTF), but concern is widespread concern that the CTF emphasizes reaching closure, has no judicial mandate, and only ensures impunity for ranking perpetrators. Indonesia and East Timorese can regain dignity and move beyond their shared tragedy through a process of reconciliation that is based on justice and atonement. Germany shows this is possible; Japan, that it is difficult and problematic if neglected. (Crit Asian Stud/GIGA)

After East Timor was hailed as a success story of nation-building in the twenty-first century the country descended into chaos and turmoil in the recent months. Since the end of April different factions of the security forces are fighting each other and communal violence is plaguing the capital Dili. In response to this outbreak of violence the government of Timor-Leste had to call for international military help. This article provides an overview of the recent events form February to mid-June 2006. It argues that the main reasons behind the current crisis lie in a failed recruitment policy of army and police personnel, an inappropriate crisis-management of the national government, a damaging dispute over historical merits between people fom the west and the east of the country, and a common discontent among many Timorese with the development process after independence. A steady reduction in the United Nations presence in East Timor coupled with failure to reach an agreement with Australia concerning control over vast offshore oil and gas deposits in the Timor Sea raised fears of East Timor (Timor Leste) sliding towards becoming a failed state only three years after finally achieving independence from Indonesia after a quarter of a century of violent struggle. The draft agreement between Australia and East Timor on sharing the contested seabed resources lying between them, finalized in May 2005, has the potential to transform this scenario. This article explores the key economic and security challenges facing East Timor as a prelude to an evaluation of the question of maritime boundary delimitation in the Timor Sea, including analysis of the positions of the contending parties and assessment as to whether the new agreement represents a just and equitable resolution of the dispute (in Australian parlance, a fair go) for East Timor. When the Democratic Republic of Timor-Leste gained full independence on 20 May 2002, the tiny nation closed a chapter in what has been one of the 20th century's most devastating conflicts. Establishing the conditions necessary to promote justice and reconciliation is an essential task for societies in transition. The paper analyses and evaluates how East Timor is coming to terms with the legacy of massive human rights violations that occurred between 1974 and 1999. Two institutions were set up in East Timor under the UN administration: In June 2000, the Serious Crimes Unit (SCU) and the Special Panel for Serious Crimes (SPSC) were created within the national judicial system, followed by the complementary installment in April 2002 of the Commission for Reception, Truth and Reconciliation (Comissão de Acolhimento, Verdade e Reconciliação, CAVR). In dem Aufsatz wird die Entwicklung Ost-Timors seit dem Ende der portugiesischen Kolonialherrschaft 1974 bis zur vollen staatlichen Souveränität 2002 beschrieben. Geschildert wird die kurze Phase der Unabhängigkeit, in der es zu harten Auseinandersetzungen zwischen den neu gebildeten politischen Parteien kam, aus denen die Fretilin als Sieger hervorging. Mit der Invasion im Dezember 1975 begann die indonesische Terrorherrschaft, deren Höhepunkt das Dili-Massaker am 12. November 1991 bildete, das zugleich einen Wendepunkt darstellte. Beschrieben werden die Formen des Widerstandes gegen die Besatzungsmacht und welche Gruppen und Akteure daran beteiligt waren (Fretilin, katholische Kirche, Studenten). Im weiteren geht es um die Veränderung der Wahrnehmung Ost-Timors in der indonesischen Öffentlichkeit und Politik in der Post-Suharto-Ära. Der plötzliche Kurswechsel Habibies leitete das Referendum vom 30.8.1999 ein. Das Endergebnis, in dem eine deutliche Mehrheit für die Unabhängigkeit Ost-Timors stimmte, löste eine Orgie der Gewalt aus. InterFET (International Force for East Timor)-Soldaten wurden in Dili eingesetzt, um die Angriffe der Milizen zu beenden. Im Weiteren werden die Aufgaben der UNTAET beschrieben, die als Übergangsverwaltung das zerstörte und unterentwickelte Land aufbauen und auf die Unabhängigkeit vorbereiten sollte. Dann wird die Phase von den Parlamentswahlen bis zur staatlichen Souveränität geschildert. Der Aufsatz endet mit der Darstellung der gegenwärtigen Lage, in der es um die wirtschaftlichen Probleme, die Verurteilung der Verbrechen der Milizen, die Außenpolitik sowie die Konsolidierung der Demokratie geht. - Im Anhang (S. 276-280): UNTAET-Übersicht; Ost-Timor-Karte; Weltbank-Statistiken.
