Disputes filed at the World Trade Organization (WTO) are attracting a growing number of third parties. Most observers argue that their participation influences the institution's rulings. The authors argue that third parties undermine pretrial negotiations; their influence on rulings is conditioned by this selection effect. They test their hypotheses, along with the conventional wisdom, using a data set of WTO disputes initiated through 2002. Consistent with the authors' argument, they find that third-party participation lowers the prospects for early settlement. Controlling for this selection effect, the evidence also suggests that third-party support increases the chances of a legal victory at the WTO. (World Politics / SWP)

Over the past decade, international non-governmental organizations (NGOs) have been contesting the neo-liberal economic order in international politics by campaigning for normative conditions to bring about what Richard Falk calls ‘humane governance’. However, the degree to which NGOs have contributed to the formation of global social contracts remains controversial. While NGO activists and various scholars advocate the establishment of such contracts, empirical testing of this normative argument is underdeveloped. Drawing upon this lack of empirical support, critics dismiss the global social contract concept and question the roles played by NGOs in international politics. This article addresses the controversy through a review, refinement and application of global social contract theory and an empirical study of two prominent international NGO campaigns directed at the World Trade Organization (WTO), an institution that represents a ‘hard test case’. It explores the ways in which NGOs and their networks are challenging the neo-liberal basis of WTO agreements and contributing to the emergence of global social contracts. The article concludes that in some circumstances, NGOs have the capacity to inject social justice into international economic contracts and there is some basis for optimism regarding the formation of global social contracts involving NGOs, nation-states and international organizations. The article analyses how the embedding of the EU into the international trading system, the WTO, leads to institutional changes within the EU. It demonstrates that embeddedness does not only effect the formal organisation of the decision-making process but also effects routines, guiding ideas and concepts of legitimate order. The article is about the motivations and reasons for the United States and Singapore to sign an FTA, prompted by little trade expansion and snail-paced financial market opening within ASEAN, the Japanese-led resistance to the full flowering of APEC, the chronic breakdown of the WTO's recent trade liberalization negotiations, the structural changes in Singapore's economy, as well as unsettled security environment in Southeast Asia. Soon after the FTA went into effect, Singapore and the United States signed a strategic ("defence") partnership agreement. Since 9/11, the two countries have found strong complementarity in each other's strategic visions — how to define the evolving security landscape for Southeast Asia, how to coordinate security responses for the region, and how bilateralism can be a viable fall-back position in cross-border trade and finance. The article also examines the inadequacies of the theories of old regionalism and suggests different ways to theorize new regionalism, identifying the domestic, regional, and global factors which have led to the paradigm shift in Singapore's strategy for future growth and survival and which have shaped the future East Asian policy of the United States. Becoming member of the World Trade Organisation was the decisive follow-up of Vietnam's reform resolutions taken in 1986. Nevertheless the process of acceding the club was not a walkover but took the SRV not less than two decades, marked by seven steps: The doi-moi-resolution(1986), the normalization of her relationship with the international financial organisations (1993), the formal applying for membership to the WTO (1995), the membership of the ASEAN (1995), of the ASEM (1996) and of the APEC (1998), and the accession to the WTO (2006/07). Having achieved this final destination, Vietnam's expectations continue to be strangely mixed. On the one hand there are at least three great opportunities for the country: to join the global trade market, to absorb capital, know-how and management, and to improve its status in the international economy and politics. On the other hand Vietnam has to meet several challenges coming up in different realms: The SRV is partially afraid of becoming confronted with a disintegration of its economy: Whereas the strong secondary sector is supposed to continue to grow, the service industry and particularly the agriculture may decline at the same time. Functionally there is much concern about efficiency and competitiveness of the economy in general and about the qualification of workers and the flexibility of the state owned enterprises in particular. Last not least there remains a conceptional problem to be settled which could trouble the political leadership. The more the Vietnamese enterprises are sticking to WTO-rules, the more the authoritarian tutelage of the CPV-leadership is becoming undermined. (Südoastasien aktuell/GIGA)
